Section 781 of the FY2026 Agriculture Appropriations Act modifies the federal definition of hemp, setting a strict limit of 0.3% total THC—including Delta-9 and THCa—on a dry-weight basis. It specifically excludes, from the hemp classification, viable seeds from cannabis plants that exceed this 0.3% limit, as well as synthetic or manufactured cannabinoids.
This legislation, effective as of the November 12, 2025, signing, also explicitly protects "industrial hemp" grown for non-intoxicating, non-cannabinoid products like fibers and oil.
